Will North Carolina Have Firearms Freedom?

With the 24 hour a day TV news media harping on the problems in Washington DC one would think eventually the people would get upset enough to “throw the bums out” and solve the problem. Trouble is there’s new bums that replace old bums or good people who cave to pressure from the bum leadership; or there simply isn’t enough good representation. People say: “This election will do it. I’m voting Republican. I’m voting Democrat. I’m switching to Unaffiliated. We need a third party”. But still no tangible changes as the country continues to go further down the tubes. But our form of government was never meant for the people to focus primarily on the Federal Government. It was meant to be a decentralized power structure where the people lobbied closest to home, to the state government and they in turn lobbied for the people to the Federal Government. Unfortunately for far too long this practice has been ignored by most Americans, resulting in a centralization of power, a near monopoly on the control of our daily lives. But that tide is turning, thanks to the hard work of a California think tank named The Tenth Amendment Center.

Recently there has been talk about the ATF outlawing certain ammunition that goes in certain guns. Usually the response has been for people to rally, complain or look to congress to “check” the president and the Federal Bureaucrats. But as more people realize that looking for the Federal Government to police itself is an utter waste of time they are looking to the states to mitigate threats like this. Other states have been ahead of the curve on this but it appears North Carolina is catching up with state noncompliance under our 10th Amendment, the last of the Bill or Rights. The 10th Amendment reads: “The powers not delegated to the United States by the Constitution, nor prohibited by the States, are reserved to the States respectively, or to the people”. In other words, all powers not expressly given to the Federal Government are reserved to the states and the people. Most people understand the three checks of the different divisions of the government: The Judicial, Legislative and Executive. But we have to continue to awaken people to the forgotten final check, state sovereignty.

Thanks to Senator Norman Sanderson R-Cartaret, Craven, Pamlico as well as more than a half dozen other senators we have The Firearms Freedom Act (S648) introduced on March 26, 2015. This bill is built on both the 2nd Amendment and the 10th. There are nine other states who have passed this bill including our neighbor to the west, Tennessee. Countless other states have introduced it in their legislatures. This bill is supported by The North Carolina Sheriff’s Association leader and Grass Roots North Carolina who’s slogan is “North Carolina’s only No Compromise Gun Rights Organization”. According to GRNC’s March 27th Action Alert The NC Firearms Freedom Act “asserts the right of the State of North Carolina to regulate the commerce of firearms manufactured in, and sold in North Carolina. Since these arms are not being sold in interstate commerce, this bill will nullify any attempts to regulate this intrastate commerce by the federal government. Attempts by the federal government to interfere in this lawful commerce will be punishable by the State of North Carolina as a criminal offense”.

There are many other 10th Amendment bills around the country being introduced to push back against the continued Federal over reach. With a single digit approval rating of congress who can blame people for looking elsewhere? From issues like legalizing industrial hemp to rebuild our agriculture and economy that has been decimated by the loss of tobacco farmers to stopping the EPA from enforcing unconstitutional executive action that hurts those dependent on wood stoves the 10th Amendment is regaining steam in North Carolina.

I trust that Senator Gunn (919-301-1446) will assist with this bill and sign on as a co-sponsor. I trust Representative Riddell and Ross will be on the lookout as it makes it’s way through the senate and over to the house. As Frank Chodorov once said “There is no end of trouble the states can give the centralizers by merely refusing to cooperate. Such refusal would meet with popular acclaim if it were supplemented with a campaign of education on the meaning of states’ rights, in terms of human freedom”.
